Benefits Available in Illinois
The Illinois Workers' Compensation Act provides the following benefits to injured workers:
- 100 percent coverage for medical benefits such as doctor visits, hospital visits, ER visits, drug costs and long-term care
- Allowed to choose two doctors
- Travel reimbursement for doctors' appointments
- Replacement wages equal to two-thirds of your gross weekly wage, subject to state minimums and maximums
- Additional compensation for disfigurement and certain injuries
- Lump sum settlement for disability that remains after you reach maximum medical improvement
- Death benefits for surviving spouse and children
- Vocational training and/or education
In Illinois, you cannot sue your employer for negligence if you are injured. Workers' compensation is your exclusive remedy for benefits in cases of work injuries. However, if a negligent third party is liable, such as a contractor or equipment manufacturer, we may be able to bring a separate personal injury suit against them.
