Types of Debt for Discharge

Types of debt that qualify for discharge include:
- Credit card debt: In most cases, all credit card debt can be eliminated. Credit card debt that has been added in the past 90 days may not qualify. Your credit card company also has the right to repossess large purchases paid for by their credit card. This means that if you purchased new furniture on a credit card in the past year, the card company may decide to take it from you.
- Medical bills: Medical costs are among the leading reasons people file for bankruptcy. Chapter 7 allows you to eliminate all debt owed to hospitals and medical care providers.
- Tax debt: Tax debt is generally dischargeable if you can show that you have made every effort to repay the debt through a supervised repayment plan over the past three years.
- Secured loans: A secured debt is a loan you take out using the car, boat or other property as collateral, in the event you fail to make payments. These are typically bank loans. Secured loans are dischargeable, but the bank will almost always repossess the property.
- Judgments: If you have had a judgment placed against you by a creditor for failing to meet a financial obligation, the amount owed may be discharged through bankruptcy, however the judgment will remain in place, unless you have it removed through separate legal process. The creditor may not, however, continue to collect on the judgment. Judgments placed against you for child support arrears may not be discharged.
- Deficiency balances: If your vehicle or personal property has been repossessed or you face foreclosure because of a deficiency balance due, it may be possible to have the deficiency eliminated through Chapter 7. You can regain possession of your property.
- Past due rent after eviction: Chapter 7 also allows you to eliminate the balance due on your rent after eviction.
- Contracts: By filing Chapter 7, you also have the option of terminating any contracts, to avoid future financial obligations you may have agreed to.
