If you have a past court 'judgment' placed against you by a creditor and choose to file bankruptcy, you may include the amount owed in your petition to eliminate or reorganize your debt. Upon discharge of the bankruptcy, you will no longer owe the debt and your creditor loses all legal rights to pursue collections. However, the judgment will remain on your record as a court judgment, until you take action to remove it. Your credit reports will continue to show the judgment, which will be a detriment to your credit rating, as well as interfere with your ability to dispose or sell the property the judgment was originally placed against. If it is your home, a title company will probably refuse to clear title until the actual judgment has been removed.
In order to dismiss the debt owed on a judgment and to end the collections actions against you or the lien placed on the property, you must ensure that the debt is included in your bankruptcy petition for discharge or restructure. Some creditors who are in collections on a past judgment may object to the discharge petition. Your attorney will need to work toward a fair arrangement or argue successfully on your behalf.
A judgment for back child support cannot be discharged under any type of bankruptcy.
If your debt owed on a judgment is part of a prior Chapter 13 debt restructure plan, you cannot have the debt amount discharged until you have completed the plan. The judgment cannot be removed from your record or credit report until you have completed the full term of the Chapter 13 supervised plan.
