General Waiting Period Before You Are Eligible to File

Generally speaking, the law requires that you cannot file to discharge your debts under Chapter 7 bankruptcy until a minimum of eight years has passed since the date of the previous discharge. However, if you are nearing the mandatory eight-year period, it is a good idea to start the process early. You may be required to hold off on formally filing your petition until the mandatory waiting period is over, or we may be able to work your claim through the system to have the time limitations waived.

If you are considering filing for Chapter 13 bankruptcy, or if you are not eligible for Chapter 7 because of the bankruptcy means test or because of the mandatory waiting period, you may file as soon as four years after the date of discharge for your previous Chapter 7.

In the event you have a previous Chapter 13 on your record, you are eligible to file again any time after you have successfully completed your court-supervised Chapter 13 repayment schedule.

Don't Assume You Aren't Eligible Because of a Previous Bankruptcy Filing
