License Suspensions for Nonpayment of Vehicle Accident Judgments
In Illinois, your driver's license can be suspended if you cannot afford to pay the judgment entered against you after a car accident. Losing your license, however, will only incur additional debt since you may be unable to get to work without a vehicle.
At The Law Offices of Chad M. Hayward, P.C., we have helped many people get their licenses reinstated. Filing bankruptcy may be a way to reduce the amount you owe on the judgment. It is important to speak with an experienced bankruptcy lawyer before you make any decisions, however. We will review your finances and debts, including unpaid judgments, to determine whether bankruptcy is a good option. How Bankruptcy May Help With Auto Accident Judgments
Filing bankruptcy halts judgments and pending lawsuits against you by providing the protection of the automatic stay, which prevents creditors from taking collection actions while the bankruptcy is in progress. The automatic stay can give us time to negotiate the amount of the judgment. Depending on the specifics of the judgment, we may be able to get it reduced to 10 percent of the original amount. In some cases, you may be able to discharge the judgment if you prove that you are currently insured.
Only car accidents caused by negligence are eligible for reduction or elimination under bankruptcy. Accidents caused by drunk driving are not eligible.
